This Privacy Policy for Due Spaghetti (“Company,” “we,” “us,” or “our”), describes how and why we might collect, store, use, and/or share (“process”) your information when you visit our site and use our services (“Services”).

We may share your data with third-party vendors, service providers, contractors, or agents (“third parties”) who perform services for us or on our behalf and require access to such information to do that work. 

Third parties with whom we may share personal information include: ad networks, affiliate marketing programs, data analytics services, payment processors, sales and marketing tools, website hosting service providers.

We may also need to share your personal information in the following situations: business transfers, when using Google Maps Platform APIs, and other users of our Site and Services.

We do not make any guarantee regarding such third party websites, services or applications. We are not responsible for the content or privacy and security practices and policies of  any third parties, including other websites, services or applications that may be linked to or from the Services. COOKIES AND OTHER TRACKING TECHNOLOGIES

HOW LONG WE KEEP YOUR INFORMATION

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting of other legal requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn tha personal information from users under 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time by contacting us at [email protected].  Please note that withdrawing consent will not affect the lawfulness of processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent. 

Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications ant any time by clicking the unsubscribe link in the emails we send, or by contacting us as [email protected]. You will then be removed from the marketing lists. However, we may still communicate with you – for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

PRIVACY RIGHTS FOR RESIDENTS OF CALIFORNIA

California Civil Code Section 1798.83, known as the “Shine The Light law, permits our users who are California residents to request and obtain from us, one a year and free of charge, information about categories or personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties which which we shared personal information in the immediately preceding calendar year.  If you are a California resident and would like to make a request, please contact us at [email protected].

If you are under 18 years of age, reside in California, and have a registered account with Services, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact us at [email protected] and include the email associated with you account and a statement that you reside in California. We will ensure the data is not publicly displayed on Services, but please be aware that the data may not b e completely or comprehensively removed from all of our systems (e.g. backups, etc.)

CCPA Privacy Notice

The California Code of Regulations defines a “resident” as: 1) every individual who is in the State of California for other than a temporary or transitory purpose and 2) every individual who is domiciled in the State of California who is outside the State of California for temporary or transitory purposes.  All other individuals are defined as “non-residents.” We must adhere to certain rights and obligations regarding the personal information of residents of the State of California.

We may also collect other personal information outside of these categories through instances where you interact with us in person, online, or by phone or email in the context of receiving help through our customer support channels, participation in customer surveys or contests, and facilitation in the delivery of our Services and to respond to your inquiries.

How we use and share your personal information

Due Spaghetti may collect and share you personal information through targeting cookies/marketing cookies, social media cookies, and click redirects to affiliate links. If you are using an authorized agent to exercise your right to opt out, we may deny a request if the authorized agent does not submit proof that they have been validly authorized to act on your behalf.

What information we may disclose for a business purpose

We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. Each service provider is a for-profit entity that processes the information on our behalf, following the same strict privacy protection obligations mandated by the CCPA. 

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be “selling” your personal information. 

Due Spaghetti has not sold or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. 

Due Spaghetti has disclosed the following categories of personal information to third parties for a business or commercial purpose in the preceding twelve (12) months:

  • Category A: Identifiers, such as contact details like your real name, alias, unique personal identifier, online identifier, Internet Protocol address, email address and account name.

Your rights with respect to your personal data

Right to request deletion of the data – Request to delete

You can call for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request an delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation, or any processing that may be required to protect against illegal activities.

Right to Limit Use and Disclosure of Sensitive Personal Information

We do not process consumer’s sensitive personal information.

Verification process

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud prevention purposes. We will delete such additionally provided information as soon as we finish verifying you. 

Other privacy rights

  • You may object to the processing of your personal information.
  • You may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the information.
  • You can designate an authorized agent to make a request under the CCPA on your behalf. Wwe may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.
  • You may request to opt out from future selling or sharing of your personal information to third parties. Upon receiving an op-ot request, we will actu upon the request as soon as feasibly possible, but no later than fifteen (15) days from the date of the request submission.

PRIVACY RIGHTS FOR RESIDENTS OF VIRGINIA

Under the Virginia Consumer Data Protection Act (CDPA):

  • “Consumer” means a natural person who is a resident of the Commonwealth acting only in an individual or household context. It does not include a natural person acting in a commercial or employment context. 
  • “Personal data” means any information that is linked to or could reasonably be linked to an identified or identifiable individual. “Personal data” does not include de-identified data or publicly available information.
  • “Sale of personal data” means the exchange of personal data for monetary consideration. 

If this definition of “consumer” applies to you, we must adhere to certain rights and obligations regarding your personal data. The information we collect, use and disclose about you will vary depending on how you interact with Due Spaghetti and our Services. We may request that you provide additional information reasonably necessary to verify you and your consumer’s request. If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request.

Upon receiving your request, we will respond without undue delay, but in all cases within forty-five (45) days of receipt. The response period may be extended once by forty-five (45) additional days when reasonably necessary. We will inform you of any such extension within the initial 45-day response period, together with the reason for the extension.

If we decline to take action regarding your request, we will inform you of our decision and reasoning behind it. If you wish to appeal our decision, please email us at [email protected]. Within sixty (60) days of receipt of an appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions.
